法学界的思辨性研究促成了法学理论知识的丰富,推动了法制体系的建立,具有不可磨灭的历史贡献。在新的时代背景下,随着司法实践日益清晰的信息反馈,传统思辨性研究偏离司法实践的弊端日趋显露,加剧了立法与实践之间的冲突,法律的明文规定面临被虚置的危险。实证研究立足于发现现实的合理性,思辨研究侧重于理性建构式的批判。实证研究具有弥补思辨性研究缺陷、传承法学知识的功能。但是,开展实证研究应当对研究成本、信息获取、研究人员与研究效果等问题给予足够重视。

The speculative research has the indelible importance in history,contributing to the legal theory knowledge and promoting the establishment of the legal system.Against the background of new era,with the increasingly clear information feedback from practice,the disadvantages that speculative research deviates from judicial practice are repealed,the conflict of legislation and practice are exacerbated,and the legal regulations face the danger of fause.The empirical study is willing to find the rationality of the reality,the speculative research focus on criticism by rational construction type.The empirical study has the functions of offsetting speculative research＇s defects and inheriting law knowledge.However,the empirical study shall give enough attention to the cost,information acquisition,researchers and research results.
