对被指控人尿液证据的强制采集会侵犯其人身自由权、身体完整权与隐私权,因此必须谨慎而为之,进行严格限制。域外国家,比如大陆法系国家的德国通常采取比例原则、法律保留原则以及令状主义进行有效规制,以实现控制犯罪与保障人权的均衡。我国关于尿液证据的采集与运用还是一片空白,相关的立法建议还存在不足,需要重新检讨。

The compulsory collection of urine evidence against the accused will infringe upon his or her right of personal liberty,physical integrity and privacy.Therefore,it must be done carefully and put strict restrictions on its application.Civil law countries,such as Germany,usually adopts the principle of proportionality,legal principles and the writ doctrine to effectively regulate it in order to achieve the balance of controlling crime and protection of human rights.China＇s regulations on the collection of urine and its use are blank.The relevant legislative proposals are still inadequate,and needs to be reconsidered.
