保辜制度是我国古代刑法中的一项重要制度，它在唐律中有完备的规定。保辜制度要求人身伤害的犯罪人对被害人进行积极的救治，视救治的效果决定犯罪人的刑罚。保辜制度能够对我国缓刑制度的改进提供有益的借鉴，它在理论、经济和社会价值上都可以给缓刑制度之发展以导引和启迪。借鉴保辜制度，我们应当建立犯罪复原性的缓刑类型，建立缓刑保证制度，这将促进缓刑制度的创造性发展与进步。
보고제도시아국고대형법중적일항중요제도，타재당률중유완비적규정。보고제도요구인신상해적범죄인대피해인진행적겁적구치，시구치적효과결정범죄인적형벌。보고제도능구대아국완형제도적개진제공유익적차감，타재이론、경제화사회개치상도가이급완형제도지발전이도인화계적。차감보고제도，아문응당건립범죄복원성적완형류형，건립완형보증제도，저장촉진완형제도적창조성발전여진보。
Baogu system is an important ancient Chinese criminal law which has been prescribed maturely in the law of Tang Dynasty. Under this system, a battery offender has the duty to rescue his victim actively and the offenderg penalty will be decided according to the effect of rescue. Baogu can offer some useful suggestions to the improvement of Chinese probation system and can inspire the development of Chinese probation in the aspects of theory, economical and social value. We should build the rehabilitation probation, a new kind probation and the system of probation guaranteed by referring to Baogu system. Doubtlessly, these new systems can be beneficial to the innovational development of probation system.
