1917年7月张勋拥废帝溥仪进行复辟，然不得人心，各路讨逆军予以围伐，复辟失败后张勋遭通缉，然而1918年10月却被特赦。赦免他的原因主要有张勋旧部替其求情；安徽督军倪嗣冲等人的通电请赦；政府认为其坐镇徐、淮，有功于北洋；其他复辟同犯前已赦免，理应亦事同一律，对张勋赦免。北洋政府枉法赦免张勋体现了民国初年法制理论与实践的脱节，也折射出理想的共和道路并不平坦。
