隐私权与知情权的冲突已是一个不能回避的现实问题和法律问题。在立法领域两者是两个有待完善的权利范畴，在司法领域两者间存在权利界限不明、责任归属不清和责任轻重不分等问题。为缓解两者间的矛盾，司法者可以依靠利益衡量司法方法，并据此发挥主动性和创造性，从实体和程序两个层面来构建完善的利益衡量司法解决机制。
隱私權與知情權的遲突已是一箇不能迴避的現實問題和法律問題。在立法領域兩者是兩箇有待完善的權利範疇，在司法領域兩者間存在權利界限不明、責任歸屬不清和責任輕重不分等問題。為緩解兩者間的矛盾，司法者可以依靠利益衡量司法方法，併據此髮揮主動性和創造性，從實體和程序兩箇層麵來構建完善的利益衡量司法解決機製。

The conflict between fight of privacy and fight to know is a social reality and legal issue which cannot be avoided. Both the right of privacy and fight to know shall be improved in legislative field ; and in ju- dicial field, there exist problems such as the boundary of right is indistinct, responsibility is vested unclearly, and level of responsibility is not classified. In order to alleviate the contradiction between them, the judicature must rely on the judicial methods of measuring interests with the initiative and creativity to construct perfect judicial settlement mechanism of measuring interests from entity and program.
