针对基金经理在基金运作的监管中存在的问题,从近几年频频发生的基金＂老鼠仓＂违规交易行为入手,采用理论与实际相结合的研究方法,在分析基金经理的法律地位及应承担的信赖义务的基础上,提出以基金运作中涉及的各方主体的角度,完善对基金经理的法律监管,从而净化基金市场,保护基金持有人的合法权益。

In view of fund managers＇ problems in the supervision of fund operations,based on illegal transactions in recent years,especially the＂Rat Trading＂and the integration of theory and practice,analyses were made of fund managers’legal status and trust obligation.On the basis of these analyses,it was pointed out that law supervision of fund managers must be improved from the perspective of subjects involved in fund operation in order to purify fund markets and protect fund holders’legitimate rights and interests.
