目前,我国公益型NGO在社会公共事务中发挥了越来越重要的作用,然而法律性质不清、参与社会公共事务主体权限不明,政府干预过多成为制约其发展的瓶颈。因此,合理、科学的界定公益型NGO的概念,并对其从事公益诉讼、解决与政府关系和法律监管上进行法律规制,才能促进公益型NGO在我国健康、有序发展。
目前,我國公益型NGO在社會公共事務中髮揮瞭越來越重要的作用,然而法律性質不清、參與社會公共事務主體權限不明,政府榦預過多成為製約其髮展的瓶頸。因此,閤理、科學的界定公益型NGO的概唸,併對其從事公益訴訟、解決與政府關繫和法律鑑管上進行法律規製,纔能促進公益型NGO在我國健康、有序髮展。

At present in China,nonprofit NGO plays an increasingly important role in social public affairs.However,it encounters a bottleneck in its development because of the unclarities in its legal nature and in its subjective rights to participate in social public affairs,and over-interposition of the government.As a result,it is necessary to reasonably and scientifically define nonprofit NGO and make out laws and rules for NGO to take part in public-service lawsuits,deal with its relation with the government,and to operate under legal supervision in order to enable NGO to develop healthily and smoothly.
