从法律关系的内容出发,国际法现阶段还应以义务为本位。从理论上分析,国际法基本原则体现了义务本位;国际强行法体现了义务本位;国际法主体内涵体现了义务本位;国家主权体现了义务本位。在国际法实践中,国际法院有关案例、海洋法、环境保护法、WTO法等都体现了义务本位。

Starting with the content of legal relationship,the international law at present stage establishes the obligation as its standard.Theoretically,the basic principles of international law reflect obligation standard;the international imperative law reflects obligation standard;the subject of the international law requires obligation standard;national sovereignty reflects obligation standard.In practice,cases of International Court of Justice,law of the sea,environmental protection law,WTO law all reflects obligation standard.
