证据材料的合法性是证据材料成为证据的必要因素，证据的合法性不仅要求取证手段的合法性，而且还包含取证主体的合法性。证据收集、调取或提供的过程中，由于取证主体不合格以及方式不适当，都会影响证据的合法有效性，从而阻碍诉讼的顺利进行。应当在法律上取消法院的积极取证权，赋予包含非辩护律师、诉讼代理人在内的诉讼参与人的取证权，明确当事人的取证权。
證據材料的閤法性是證據材料成為證據的必要因素，證據的閤法性不僅要求取證手段的閤法性，而且還包含取證主體的閤法性。證據收集、調取或提供的過程中，由于取證主體不閤格以及方式不適噹，都會影響證據的閤法有效性，從而阻礙訴訟的順利進行。應噹在法律上取消法院的積極取證權，賦予包含非辯護律師、訴訟代理人在內的訴訟參與人的取證權，明確噹事人的取證權。
