被害人承诺,作为正当化事由之一,是关于公民私权与国家、社会公权的界限划分的理论,进而也体现了国家对于法秩序不同价值的取向,世界各国大都为其设定了不同的成立条件。但是该理论在我国刑事立法中没有建立,在注重人性化与法治化的今天,我国必然会将其立法化,因此研究被害人承诺的成立要件就具有了现实的意义。本文拟从承诺权限、主体、主观方面、时间、承诺方式、社会正当性等六个方面来论述被害人承诺的成立要件。

As one of justifiable reasons,the theory of victim＇s commitment is about the divide between the private right of the citizen and the public power of the nation and the society,which has also reflected the national orientation in the different legal orders and values.Many countries in the world have made different conditions for the existence of it.But in our national criminal legislation,this theory has not established.With the attention to human nature and government by law today,our country can inevitably finish its legislation.So it is important to make research on victim pledged tenable condition.The paper describes of the establishment of Victim elements from the commitment authority,subject,subjective,time,commitment,and social legitimacy.
