研究目的:为推进中国不动产统一登记提供建议。研究方法:描述性研究。研究结果:中国分散的不动产行政管理体制导致了分散的不动产登记制度;登记矛盾和冲突问题是迫切需要解决的分散登记弊端;构建中国不动产统一登记制度时,应当贯彻统一性、有效性、效率性、可行性等原则;推进不动产统一登记,一是必须从法理上合理界定不动产物权的关系,明确以土地登记为基础,二是不动产登记机关可选择行政机关,三是在过渡期可通过优化登记机关职能来推进统一登记。研究结论:当前可构建以土地登记为基础的统一的不动产登记过渡方案,即以土地所有权登记为基础,统一协调、行使“不动产权利类型认定”和“不动产界址划定”两项职权,建立协调或者统一的不动产登记信息系统来推进不动产统一登记。

연구목적:위추진중국불동산통일등기제공건의。연구방법:묘술성연구。연구결과:중국분산적불동산행정관리체제도치료분산적불동산등기제도;등기모순화충돌문제시박절수요해결적분산등기폐단;구건중국불동산통일등기제도시,응당관철통일성、유효성、효솔성、가행성등원칙;추진불동산통일등기,일시필수종법리상합리계정불동산물권적관계,명학이토지등기위기출,이시불동산등기궤관가선택행정궤관,삼시재과도기가통과우화등기궤관직능래추진통일등기。연구결론:당전가구건이토지등기위기출적통일적불동산등기과도방안,즉이토지소유권등기위기출,통일협조、행사“불동산권리류형인정”화“불동산계지화정”량항직권,건립협조혹자통일적불동산등기신식계통래추진불동산통일등기。
The purpose of the paper is to propose suggestion for developing a unified real estate registration system in China. Descriptive research method was employed in this study. The results indicated that the divided real estate administration system in China leads to the divided real estate registration system, which causes serious problems of registration contradictions and conflicts. Unity, effectiveness, efficiency and feasibility should be carried out as principles for developing the unified real estate registration system in China. The results of the paper show that 1) legal relationship of various real properties has to be defined clearly and land registration should be the most fundamental element in the registration system. 2) Administration authority should be responsible for the unified real estate registration. 3) Current registration authorities’function can be ameliorated for developing the unified real estate registration. It is concluded that we can then develop a transitional solution for the aimed unified real estate registration system, taking land ownership registration as the basis, coordinately identifying real estate rights and location boundary, and supplemented by a coordinated real estate registration information system.
