从实际处置出质知识产权时的变现问题出发,通过介绍知识产权的价值评估方法,分析出质知识产权变现价格的影响因素,推导出＂知识产权产品的市场份额＂、＂知识产权变现时间＂对其变现价格具有重要影响这一结论。进一步的论述表明,以＂质权人同意＂作为出质知识产权转让或许可的前提条件,对质权人、出质人及社会总体的效益均有妨碍,因而应该允许出质人在质权人实行质权前转让或许可出质知识产权,而无须取得质权人的事先同意。为此,建议对物权法进行相应修改,将＂取得质权人同意＂代之以＂出质人的通知义务＂,并赋予质权人撤销权及出质人提供替代担保物的选择权。

Fi/-stly, this article discusses the realization of pledged intellectual property, introduces the evaluation methods of it, expounds the influence elements of its realization price, and gets the result that the market share and realization time playing very important roles in that price. Secondly, the essay puts forward that if the disposition of pledged intellectual property is agreed by the pledgee, it will hamper the interest of the pledgee, pledgor and the whole society. So the Property Rights Law shall allow the pledgor to transfer or permit the pledged intellectual property without the agree of the pledgee in advance, but the pledgor should inform the pledgee in time. Furthermore, the law shall give the pledgee right of rescis- sion, and give the pledgor right of suppling substitution for thing pledged.
