关于入户抢劫是否具备入户目的的非法性历来是学界争论的一个问题,尽管《关于审理抢劫案件具体应用法律问题若干问题的解释》和《关于审理抢劫、抢夺刑事案件适用法律若干问题的意见》都是持肯定的态度。但是从立法本意来看,入户抢劫除了保障财产权之外,更重要的还要保护居民对＂户＂的信任感和安全感;＂入户＂目的非法性也并不影响主观有责性的成立和客观违法性的程度;入户方式合法与否也并非刑法所关注的内容,所以入户抢劫并不需要入户时具有非法目的。

It has always been controversial among scholars on the illegalness of indoor purpose in the case of indoor robbery.The Interpretation of Application of Specific law to the trial of robbery cases and the Views on Application of Specific law to the trial of robbery and snatch criminal cases hold a positive attitude.However,from the legislative point of view,indoor robbery defines protection of property rights,and more importantly,the protection of residents＇ trust and security of ＂home＂;Illegalness of ＂indoor＂ purpose does not affect the illegal nature of the subjective responsibility and its severity of objective illegalness;the criminal law mentions nothing about the illegalness of indoor robbery,so it is unncessary define the unlawful purpose in burglary.
