食品安全直接关系到人们的身体健康，而当前的食品安全形势却不容乐观。正确适用食品领域的惩罚性赔偿。让违法者对受害人进行超出实际损害的赔偿，有助于防止违法行为的再次发生。但适用时还存在适用条件有失合理、程序欠妥、赔偿基数有失公平等问题，因而应适当扩大适用条件、创建便利的求偿程序、合理确定赔偿数额和尝试新的求偿机制，以真正实现惩罚性赔偿的法律价值。

However, when punitive damages is applied, harsh applicable conditions, the defective program, unfair compensation base and other issues are involved in, we may be appropriate to extend the applicable conditions, construct the facilitate claims process, ascertain the amount of compensation properly and try the new compensation mechanism, in order to truly realize the legal value of punitive damages.
