《物权法》首次以民事基本法的形式确立了不动产登记错误下登记机关的赔偿责任,但由于过于简化,学术界与司法界对其有多种片面的解释。针对《物权法》关于不动产登记错误登记机关的赔偿责任的相关规定,结合法理,阐析了不动产登记错误的赔偿范围、登记机构承担赔偿责任后的追偿权实现、嘱托登记错误下不动产登记机构负赔偿责任的不妥之处,以期不动产登记错误赔偿责任的相关规定能够在公平、善良、诚信的框架下得以实施。

For the first time,the ＂Property Law＂ identifies the responsibility on compensating for the mis-registration of real estate in a form of civil fundamental law.However,the oversimplification of the regulations has yielded various kinds of biased interpretation from both academic circles and judicial circles.Combining legal principles with the relevant provisions of the ＂Property Law＂,concerning the responsibilities for the registration organization to compensate for the mis-registration of real estate,the author analyses the scale of Compensating for Mis-registration of Real Estate,for which the registration organization assumes the responsibilities to resume the right of indemnity,and also points out the improper implementation made by the real-estate registration organization under the circumstance of mis-registered request.Hopefully,the related provisions of compensating for mis-registration of real property will be implemented effectively in accordance with the credo of fairness,kindness and credit.
