现行制度设计下的扣押款物移送处理屡屡暴露出问题,甚至因扣押款物处理失当引发公检法三机关之间权责纠纷。故此,在保护诉讼当事人合法权益和不断提高司法效率的原则下,公检法三机关通过联合制定科学合理的扣押款物移送处理办法,搭建扣押款物共管平台,建立一套切实可行的扣押款物移送处理机制,将有助于更好地服务刑事诉讼整体工作,实现法律效果和社会效果的统一。

Problems have been appearing repeatedly concerning distraint transfer in the current system.The improper handling of distraint even leads to authority-responsibility disputes between the three organs of the public security,the procuratorate and the court.Accordingly,the three organs should,under the principles of safeguarding the legal rights and interests of litigants and improving judicial efficiency,co-work out a scientific method for distraint transfer,co-build a platform for managing distraint and co-establish a practical and workable mechanism for distraint transfer,all of which will help serve the whole criminal litigation process and realize the unity of legal and social effects.
