教育实践和教师教育权的结构与性质决定,必须在法理上明确教师教育权对相对人具有强制性。从认识到制度层面分析,体罚、心罚或教师怠于管理都是对教师教育权强制性的误读及制度设计上的缺陷所致,教师教育权强制性的缺失也有悖干权利与义务辩证统一的基本法理。教师教育权具有公权力性质,是法定的专业职务权力,这也决定教师教育权具有强制性。
教育實踐和教師教育權的結構與性質決定,必鬚在法理上明確教師教育權對相對人具有彊製性。從認識到製度層麵分析,體罰、心罰或教師怠于管理都是對教師教育權彊製性的誤讀及製度設計上的缺陷所緻,教師教育權彊製性的缺失也有悖榦權利與義務辯證統一的基本法理。教師教育權具有公權力性質,是法定的專業職務權力,這也決定教師教育權具有彊製性。

Concerning the educational practice and analysis of the nature and composition of teacher's right to education, we believe that teacher's right to education for counterpart must be definitely mandatory in law. From the perspectives of conception and institution, physical and mental punishment or remiss in management are caused by misunderstanding of the mandatory nature of teacher~ right to education and defects in institution de- sign. Lacking of the mandatory is contrary to the basic legal principle of dialectical unity between rights and obligations. Teacher's right to education is a public power in nature and statutory power in professional positions, so it is of mandatory nature.
