听证程序已逐渐融人我国公共权力运行机制，开始成为公众参与和评价的一种主要形式。最新修改施行的《烟草专卖行政处罚程序规定》对听证程序做了修改完善，具有一定的进步意义。但其在听证程序的适用范围，案卷排他性制度，听证主持人制度等方面并未有实质性突破，存在诸多缺憾，有待进一步改进。

Hearing procedure has gradually integrated into China＇s public power operation mechanism, which has begun to become a main form of public participation and evaluation. The latest revision of Tobacco Monopoly of Administrative Punishment Procedures has modified and improved the hearing procedure, which have certain progressive significance. But on aspects like hearing procedures applicable scope, files exclusiveness system, hearing host system, etc, it has no substantive breakthrough and existd many deficiencies, which needs further improvement.
