禁止重复评价原则是刑法中的重要原则,但就其内涵和适用对象,学界和实务界并无明确界定。禁止重复评价的原则是同一犯罪,评价主体是刑法,必须在同一诉讼中适用。这一原则应当是罪责刑相适应原则在量刑上的派生原则,是一项立法原则也是司法上的量刑原则。
