行政诉讼中法院对事实问题进行审查,涉及司法审查的强度和证明标准的具体运用。目前严格的司法审查强度和不明确的证明标准严重影响法院裁判的公正性。应根据行政行为的性质、行政程序控制程度以及判决的种类,确立严格、适度和微弱的多层次司法审查强度,运用与之相应的排除合理怀疑、清楚而具有说服力和优势证据的证明标准。

In administrative lawsuit,the fact examination of the court should have the intensity of judicial review and the proof standards.Now the strict intensity of judicial review and the unclear proof standards have a negative effect on the justice of the court decision.On the basis of the nature of the administrative act and the administrative procedure control degree and the judgment category,the strict moderate multi-level judicial review intensity should be established,together with the clear and convincing corresponding proof standards which can remove the reasonable doubts and have the evidence preponderance.
