我国无罪判决率明显较低,20世纪80年代至90年代初,全国无罪判决基本上维持在每年2000件左右,占全部刑事案件的千分之四左右,到90年代末无罪率有所提高,最近几年无罪判决数量增加明显,每年的无罪判决超过6000件,无罪判决率也只有百分之一左右。我国是否应当在法律上明确规定无罪推定原则？刑诉法第12条只是吸收了无罪推定的某些精神,但尚未确定无罪推定。无罪推定在我国的确定仍是刑诉法修改的一个未完成的课题。

아국무죄판결솔명현교저,20세기80년대지90년대초,전국무죄판결기본상유지재매년2000건좌우,점전부형사안건적천분지사좌우,도90년대말무죄솔유소제고,최근궤년무죄판결수량증가명현,매년적무죄판결초과6000건,무죄판결솔야지유백분지일좌우。아국시부응당재법률상명학규정무죄추정원칙？형소법제12조지시흡수료무죄추정적모사정신,단상미학정무죄추정。무죄추정재아국적학정잉시형소법수개적일개미완성적과제。
China＇s acquittal rate was significantly lower that from the 1980s to the early 1990s,the National not -guilty verdict basically maintained at about 2000 per year,accounting for about four thousandths of all criminal cases;to the late 1990s the number has increased;and the number of acquittals in recent years has increased significantly to over 6000 each year,accounting for one per cent only. Whether China should be clearly defined the presumption of innocence in law？ Article 12 of Criminal Procedure Law just absorbed some spirit of the presumption of innocence,but the presumption of innocence has not been determined. Presumption of innocence in China remained an unfinished task for the modification to Criminal Procedure Law.
