《刑法修正案（八）》已经明确将危险驾驶入罪。我们从醉酒状态的认定入手，认为应将血液检测作为涉嫌醉酒驾驶类危险驾驶罪的刑事取证必经程序；在醉酒驾车者的刑事责任能力方面，对相关理论进行评析，提出可以引入期待可能性理论确定不同类型醉酒者的刑事责任；在主观状态方面，认为醉酒驾驶是故意犯罪，并对自愿醉酒、非自愿醉酒两种类型的主观故意进行分析。
《刑法脩正案（八）》已經明確將危險駕駛入罪。我們從醉酒狀態的認定入手，認為應將血液檢測作為涉嫌醉酒駕駛類危險駕駛罪的刑事取證必經程序；在醉酒駕車者的刑事責任能力方麵，對相關理論進行評析，提齣可以引入期待可能性理論確定不同類型醉酒者的刑事責任；在主觀狀態方麵，認為醉酒駕駛是故意犯罪，併對自願醉酒、非自願醉酒兩種類型的主觀故意進行分析。
《형법수정안（팔）》이경명학장위험가사입죄。아문종취주상태적인정입수，인위응장혈액검측작위섭혐취주가사류위험가사죄적형사취증필경정서；재취주가차자적형사책임능력방면，대상관이론진행평석，제출가이인입기대가능성이론학정불동류형취주자적형사책임；재주관상태방면，인위취주가사시고의범죄，병대자원취주、비자원취주량충류형적주관고의진행분석。
The Amendment to the Criminal Law of the People＇s Republic of China （VIII） has convicted the dangerous driving. We focus on the drunken driving behavior. Starting from the identification of the status of drunken, blood test should be the necessary procedure in the crime of dangerous driving criminal forensics. In terms of drunk drivers＇ criminal responsibility, we propose possibility theory to determine the criminal responsibility of different type drunk driver through analysis relevant theory. In terms of drunk drivers＇ subjective, we also propose that drunk driving is a deliberate crime. Furthermore, we analysis and compare the subjective activity of voluntary intoxication and involuntary intoxication.
