网络恶意传播不雅电子信息行为是在互联网中通过上传、下载、链接等方式恶意传播公民私密信息的行为，该行为以内容不雅的视频、照片、文字、声音、图像等为对象，在动机、方式、过程、内容等方面都具有特殊性。结合现行刑法的规定，可以侮辱罪、传播淫秽物品罪等追究行为人的相应责任。
