公平正义价值理念是法律发挥作用的前提。公平正义的价值实现是司法的当然选择,法的运行的必然要求及实效的客观需要。司法中当事人正当诉求的忽视,法律工作者职业伦理的缺失,秩序价值的过分偏重,阻碍着公平正义价值的实现。实现公平正义的价值,要尊重当事人的正当诉求,自觉维护法律职业伦理,保障正义与秩序价值的均衡。
公平正義價值理唸是法律髮揮作用的前提。公平正義的價值實現是司法的噹然選擇,法的運行的必然要求及實效的客觀需要。司法中噹事人正噹訴求的忽視,法律工作者職業倫理的缺失,秩序價值的過分偏重,阻礙著公平正義價值的實現。實現公平正義的價值,要尊重噹事人的正噹訴求,自覺維護法律職業倫理,保障正義與秩序價值的均衡。
공평정의개치이념시법률발휘작용적전제。공평정의적개치실현시사법적당연선택,법적운행적필연요구급실효적객관수요。사법중당사인정당소구적홀시,법률공작자직업윤리적결실,질서개치적과분편중,조애착공평정의개치적실현。실현공평정의적개치,요존중당사인적정당소구,자각유호법률직업윤리,보장정의여질서개치적균형。
The value concept of fair and justice is the fundamental premise for laws to play a role in social reality.The realization of fair and justice＇s value is the natural selection of justice,the inevitable requirement of law operation,and the objective need of its actual effect.Neglecting rightful demands of the parties in judicial practice,lacking professional ethics of legal workers,and paying too much attention to order value,impede the realization of fair and justice.To realize the value of fair and justice,it is important to respect the rightful demands of parties,maintain the legal professional ethics consciously and balance the value of justice and order.
