知识产权信托作为知识产权转化的最佳途径,在国外已经开始被广泛采用,但在中国的实施前景并不理想。如何推动知识产权信托业务的开展成为目前急需考虑的问题。为了充分发挥知识产权的效用,通过对我国知识产权信托制度及其运行的分析,得出知识产权转移具有特殊性、信托风险的防范设计不尽合理、受托人义务规定不明确、信托登记制度不完善,应建立合理的知识产权信托运行机制,完善信托立法。

Intellectual property trust,as the best approach for transforming intellectual property,has been widely adopted abroad.Unfortunately,it is rarely put in practice in China.It is thereof an urgent issue to start the concrete practice of intellectual property trust in our country.In order to take full advantage of intellectual property,the imperfection of the intellectual trust system is discussed in the paper from the aspects of the particularities and the complications in the transformation of intellectual property and the unreasonable systematic design;it also attempts to put forward series of suggestions on several complicated problems such as the unreasonable design of risk prevention mechanism,and the ambiguous and immaneuverable obligation of the trustee,with an aim at perfecting legislation and constructing reasonable operational mechanism of intellectual property trust.
