中国是一个航运大国,也是世界海事组织的理事国,且有着较大的油类进出口量,然而它却不是<1992国际油污赔偿基金公约>的成员国,而且也尚未建立国内油污基金.针对以上情况,论述国内油污赔偿基金建立的必要性,比较国际上现有的三种油污基金模式,分析油污基金的法律特征,提出建立国内油污基金的建议.

China, as a big shipping country and a council of International Maritime Organization (IMO), has great amount of oil imports and exports. However it is not a member state of the International Oil Pollution Compensation Fund 1992 (FUND 92) and does not establish a national compensation fund for oil damage. This paper compares the current three different compensation fund models and analyzes the legal characters of the oil pollution compensation fund, then gives some suggestions on establishment of national oil pollution fund in China.
