随着经济的发展,土地资源的有限性和社会发展需要之间的矛盾日益扩大,土地的立体利用越来越普遍,土地空间利用纠纷也相应增加。土地空间利用权是一种独立的用益物权与新型的财产权。我国物权法仅对建设用地空间利用权作了原则性规定,缺乏可操作性。我国应完善空间利用权的种类、空间利用权的取得方式、空间利用权的空间范围以及空间利用权的流转。

With the economic development, the contradiction between the limitation of the land resource and the need for the social development has been increasing strikingly. And the spatial employment of land is becoming more and more univer- sal. Consequently, the contradictions of such employment have increased. The space-using right of land is an independent usu- fructuary right and a new kind of property right. Property Law in China only provides principally space-using right of the land for construction purpose and it lacks maneuverability. Accordingly, we should perfect the types of space-using rights, the ways to obtain such rights and their extent and circulation.
