随着经济的发展，土地资源的有限性和社会发展需要之间的矛盾日益扩大，土地的立体利用越来越普遍，土地空间利用纠纷也相应增加。土地空间利用权是一种独立的用益物权与新型的财产权。我国物权法仅对建设用地空间利用权作了原则性规定，缺乏可操作性。我国应完善空间利用权的种类、空间利用权的取得方式、空间利用权的空间范围以及空间利用权的流转。

수착경제적발전，토지자원적유한성화사회발전수요지간적모순일익확대，토지적입체이용월래월보편，토지공간이용규분야상응증가。토지공간이용권시일충독립적용익물권여신형적재산권。아국물권법부대건설용지공간이용권작료원칙성규정，결핍가조작성。아국응완선공간이용권적충류、공간이용권적취득방식、공간이용권적공간범위이급공간이용권적류전。
With the economic development, the contradiction between the limitation of the land resource and the need for the social development has been increasing strikingly. And the spatial employment of land is becoming more and more univer- sal. Consequently, the contradictions of such employment have increased. The space-using right of land is an independent usu- fructuary right and a new kind of property right. Property Law in China only provides principally space-using right of the land for construction purpose and it lacks maneuverability. Accordingly, we should perfect the types of space-using rights, the ways to obtain such rights and their extent and circulation.
