保险业需要竞争也需要反垄断豁免已成为各国的共识,区别在于豁免的模式和范围。美国和欧盟作为最重要的反垄断法域,分别对保险行业采取了立法和条例的方式予以豁免。然而,随着时间的推移,美国模式由于立法的僵硬、豁免范围不合理以及众多负面影响受到了越来越多的质疑,欧盟模式则避免了这些缺点,且能够随经济社会的不断发展而修正。因此,明确保险业市场结构特征以及豁免经济效率,借鉴欧盟的模式,采取条例方式明确豁免范围,有利于整个保险产业长期、健康、稳定地发展。

The necessity of both competition and anti-monopoly exemption for insurance sector has become the common view in many counties.However,there are different patterns and scopes of exemption in different countries and areas.As the most important legislative regimes of anti-monopoly,America and EU takes statute and BER respectively to exempt insurance sector.It is proved that the American pattern is questionable because of its stiff statute,unreasonable scope of exemption and many negative impacts.The European pattern can overcome these defects and be in accordance with the development of the economy and society.Therefore,understanding the market structure of insurance sector and the economic efficiency of exemption,borrowing from the European pattern and clarifying the scope of exemption by regulations will benefit the long-term healthy and stable development of Chinese insurance sector.
