在法经济学看来,当前中国贫困问题的产生根源主要体现为反贫困法律制度供给不均衡和法律程序制定的垄断收益.基于此,中国反贫困法律制度的有效供给应以宪法中有关公民基本权利的规定为依据,以物权法为基础,以经济法、社会保障法、劳动法以及自然资源与环境保护法等社会法为主要内容,由专门性反贫困立法和相关性制度建设共生形成的制度系统.

In View of Law and Economics, The roots of China's current problem of poverty are mainly reflected by the supply for not balanced legal system and monopoly revenue of legal procedures enacted. Based on this, China's anti-poverty legal system should be a symbiotic system that effectively supplys for basic civil rights relating to the Constitution (especially the right to life, the right to development, the right to obtain relief, etc.) , property law as the basis, economic law,social Security Law, Labor Law and Natural Resources and Environmental Protection Act, and other social law as the main content, and special anti-poverty legislation and relationed institution building.
