有期徒刑是我国刑罚体系中的核心刑种,是适用范围最广泛的刑种之一。但有期徒刑也存在着一些问题,基于刑事法律的特殊性,不在立法上规定,司法中是很难有所作为的,因此对有期徒刑在立法上应从提高有期徒刑的法定最高刑期、缩短有期徒刑法定刑的幅度等方面进行完善。
유기도형시아국형벌체계중적핵심형충,시괄용범위최엄범적형충지일。단유기도형야존재착일사문제,기우형사법률적특수성,불재입법상규정,사법중시흔난유소작위적,인차대유기도형재입법상응종제고유기도형적법정최고형기、축단유기도형법정형적폭도등방면진행완선。
Limited imprisonment is the core punishment of our country penalty system and it is one of the most widely used punishment types.But there are also some problems about limited imprisonment.Based on the particularity of criminal law,if don＇t provide at the legislation,the administration of justice is very difficult to make a difference,so limited imprisonment should be perfected from the aspects of improving the highest prison term of limited imprisonment,shortening the range of statutory punishment of limited imprisonment.
