政治制度背后是一些基本理念和由理念构筑的逻辑,运行良好的文本制度必须是与这些理念逻辑相适应的。我们可以学习西方司法制度的权力体系、组织建设,却难以建立起与之相配的司法理念,两者的不一致在一定程度上造成了司法中的种种尴尬局面。本文试图通过对比辛普森和赵作海这两个案例,引入统计学中Ⅰ类错误和Ⅱ类错误的概念,从中观察中美司法理念和逻辑的差异。

There are some basic concepts and ideas constructed by the logic behind political system,text system works well must be adapt to these concept of logic.We can learn the power of the western system of justice system,organization,but it is difficult to establish the concept of justice match with it,the two are inconsistent,which caused a certain extent,the various judicial embarrassment.This paper attempts to compare Simpson and Zhao Zuohai both cases,introduce the concept ofⅠmistake and Ⅱ mistake in statistical misconceptions,and observe the differences between American and Chinese philosophy and logic.
