未成年犯罪人不同于成年犯罪人,本着未成年人保护和预防未成年人犯罪的原则,在未成年犯罪人的刑罚执行方式上也应和成年人相区别。现阶段,未成年人社区矫正法律制度与其他法律制度相比,在未成年人法律体系中处于弱势,而该种状况不适应未成年人保护,预防未成年人犯罪,社区矫正应有功能的需要。在未成年人法律制度建设中,应该根据现有法律的调整和未成年人健康成长的需求,逐步完善未成年人社区矫正的立法。
미성년범죄인불동우성년범죄인,본착미성년인보호화예방미성년인범죄적원칙,재미성년범죄인적형벌집행방식상야응화성년인상구별。현계단,미성년인사구교정법률제도여기타법률제도상비,재미성년인법률체계중처우약세,이해충상황불괄응미성년인보호,예방미성년인범죄,사구교정응유공능적수요。재미성년인법률제도건설중,응해근거현유법률적조정화미성년인건강성장적수구,축보완선미성년인사구교정적입법。
The juvenile criminals are different from the adult,so according to the protection of minors and prevention of juvenile delinquency,the way in the execution of punishment should be distinguished from adult criminals,which is the basic principle of a community correction in the application.At present,compared with other legal systems,the legal systems of community correction of minors are in disadvantage,which cannot meet the requirements of protecting minors,preventing juvenile delinquency and community correction.So,we should complete legislative adjustments of community correction for minors based on the needs of adjustment of law and healthy growth of minors during the course of the construction of legal system on minors.
