通过对经济法的产生原因及其本质属性的分析,论证经济法是二次分配的法：一方面,经济法的产生原因决定了经济法是二次分配的法,其产生的宗旨和目的并非确保经济生活中单个经济主体的经济利益得以实现,而是通过对传统民法规制下的单个经济主体的自由放任的经济行为进行干预,对社会经济进行二次分配;另一方面,经济法的本质属性决定了经济法是二次分配的法,其本质属性要求其在市场经济第一次分配的基础上,通过国家对社会经济生活的干预与调控,对社会经济进行第二次分配。
