随着全球化背景下国际间交往的增多,国际法律制度的表现形式及形成机制也发生了较大的变化,非传统的无法律约束力文件因其形式简单及灵活性而受到国际社会的青睐,其对国际社会的影响日益增强.国际原子能机构的"行为准则"就是这样一种无约束力的行为规则,其形成过程及其在国际上效力的发挥都不同于传统的国际法律,只有更多地关注无约束力行为准则,才能及时地把握国际核能法律发展方向、拥有国际核能源利用及安全领域立法的主动权.

The paper mainly discusses that with the increase of international communication, the performance of the international legal system and its formation mechanism has recently undergone remarkable changes; simplicity and flexibility of non-traditional, as well as non-legal constraint document has found favor in the international community. The paper points out that "code of conduct" of IAEA is a non-binding rule of conduct, whose formation process and effectiveness in the international community has played all different from the traditional international law. The paper proposals that only when we pay more attention to non-binding code of conduct can we catch the direction of the international nuclear energy law, and have the legislative initiative in the area of international nuclear energy use and security.
