我国民法通则规定,公民的民事权利能力始于出生终于死亡。自然人生前享有人格权,但自然人死后其人格利益是否需要保护和如何保护是一个值得研究的理论和实践问题,对此学界观点不一。目前,我国对于死者人格利益保护的相关法律制度还很不完善,本文对死者人格利益保护的理论基础、法律依据及必要性进行了分析,对死者人格利益的民法保护进行了思考,并提出了一些相关的立法建议。
