非法财物没收制度的精准化有赖于把握其法律性质与法律构成。非法财物没收的法律属性不能一概而论，没收违法工具属于行政处罚，没收违禁品属于保安处分。没收的法律属性的不同，归责原则和法律构成也不同。除了没收的基本构成，还有一些针对特殊情况的修正构成，如比例没收、扩大没收、替代没收。

The precision of illegal property confiscation system depends on its legal nature and constitution. The legal attributes of illegal property conifscation can not be lumped together. Conifscation of illegal tools belongs to administrative punishment, while conifscation of contraband goods belongs to security measures. Different legal attributes of conifscation lead to different liability principles and legal constitutions. Besides the basic constitution of conifscation, there are also some amended constitutions aiming at speciifc conditions, such as proportional conifscation, expanding conifscation and substitutional conifscation.
