党的十七届三中全会对农村集体建设用地使用权流转进行了重大改革，要求逐渐建立城乡统一的建设用地市场，准许农村建设用地使用权进行上市流转。随之而来的就是要着手建构农村集体建设用地使用权上市流转的体制和制度。制度和体制的建构需要对现有的各种理论前提条件进行梳理性反思，既要看到影响农村集体建设用地使用权上市流转的障碍性因素，又要看到农村集体建设用地使用权上市流转的必要性和现实可能性，发现构建农村集体建设用地使用权上市流转体制要着力解决的一些关键性问题，从而为有针对性地建构农村集体建设用地使用权上市流转制度做好理论准备。

The Third Plenary Session of the l7th Central Committee of the Chinese Communist Party under-took major reform of rural collective construction land-use rights system, requesting setting up a unified ur-ban and rural construction land market gradually, allowing collective construction land-use rights to enter the market. The next is to construct the system of rural collective construction land-use rights into the market for transfer. We should summarize and reflect the existing various theoretical resources before construction of the system .We must not only take notice of the obstacle factors of rural collective construction land-use rights in-to the market for transfer, but also see the necessity and realistic possibility. And at the same time, we are sup-posed to find out some key problems that should be focused on solving in the construction of collective con-struction land-use rights transfer system. Thus we make theoretical preparations for construct the rural collec-tive construction land-use rights transfer system.
