中国近年的专利激增引发了国际社会热议。质疑激增专利质量之余，从战略视角解读专利激增现象对于企业理解并利用专利制度参与国际市场竞争具有现实意义。本文以ICT企业国际竞争为实证，根据创新能力演变、专利制度及专利管理特性，从知识产权制度支撑体系视角分析现行创新体系内核中存在的困境及可行的选择。企业既要利用好专利诉讼的竞争属性，又需深谙竞争规则，在创新、专利、市场间建立起三维联动机制。

The patent surge in China in recent years has ignited a hot discussion about the driving forces, science and technology policy, and its performance behind the economic miracle in China from the international community. On the way to understand China's catching-up and the evolution of its innovation capability, it is significant to examine this tide of patent explosion from a strategic perspective. This article takes some leading domestic ICT companies as examples to investigate their practices on internationalization by shedding lights on the strategic use of patent system. Their practical experiences and lessons give valuable suggestions for domestic companies to make self-examining and market exploitation when walking towards global competitive innovation. It is concluded that domestic companies should have an in-depth understanding of the nature of patent system in the international competition and try to establish a good 3-dimensional linkage mechanism of innovation, patent, and market.
