中国《民法通则》和《合同法》没有就无效合同确认是否受诉讼时效限制做出相应的明确规定，无效合同诉讼时效问题引起了合同法理论界和实务界的争论。文章将时效制度与合同无效制度能力加以权衡比较，对合同无效的确认是否适用诉讼时效做出了肯定判断，并对合同无效确认后时效期间起算等问题进行了分析阐述。

As the General Principles of the Civil Law and the Law of Contract of China do not provide the limitation of actions concerning the affirmation of invalid contracts ,there are disputes over the question of limitation of actions in theory and practice .This paper ,through the research on the trade-off of prescription system function and the invalid contract system function ,helps to determine wheth-er the affirmation of invalid contracts is applicable to the limitation of actions .Moreover ,this paper analyzes the limitation of right of claim after the affirmation of invalid contract ,the beginning time of prescription period ,and other issues as well .
