司法话语权，是司法话语权主体所拥有对法院司法审判过程的言说行为权，是司法话语权主体对法院审理、判决案件的司法过程所享有的表达其利益、主张与要求的话语资格。司法话语权主体，则是享有司法话语权的个人或集体。司法话语权主体行使司法话语权所形成的各种司法话语汇集的博弈场所，就是“司法话语场域”。

사법화어권，시사법화어권주체소옹유대법원사법심판과정적언설행위권，시사법화어권주체대법원심리、판결안건적사법과정소향유적표체기이익、주장여요구적화어자격。사법화어권주체，칙시향유사법화어권적개인혹집체。사법화어권주체행사사법화어권소형성적각충사법화어회집적박혁장소，취시“사법화어장역”。
Judicial discourse capacity is speech capacity with which the subject has the right of speech act during the judicial process and a kind of discourse capacity with which the subject has the right to express their interest , views and requirement during the judicial process . The subject of judicial discourse is a personal or collective that enjoys judicial discourse capacity . In the game field of judicial discourse , the subject exercises judicial discourse capacity which constitutes the “judicial discourse field” .
