License Restrictions%assist in the execution%transfer vehicle ownership
基于缓解交通拥堵等公共利益的考量,我国上海、北京、贵阳、广州等地政府相继颁布并实施“车辆限牌令”。由于“限牌令”限制了法院判决、裁定直接进行车辆过户的物权登记规定,藉此对法院的协助执行法律文书增设了车辆指标证明的条件,致使法院陷入强制执行之困境。“限牌令”的上述制度安排,从法理上说有不当立法、越权审查司法文书和增设行政许可之虞,同时其规制成本过高,因规避虚假诉讼而有因噎废食之过。在此背景下,有必要从完善人大的备案审查制度、确立法院的司法主体地位、畅通当事人诉讼的救济途径、启动行政诉讼的司法审查程序和建立行政立法的利益表达、意见沟通机制等五个方面对其进行梳理和整合,从困境中突围而出。

Based on such public interests as easing traffic jams , the governments of Beijing , Shanghai , Guiyang , and Guangzhou promulgated and implemented the vehicle license limit order .License Restrictions restrains the court decision from directly trans-ferring vehicle ownership of property registration , and adds certification requirements of vehicle index to the assistance in execu-tion of legal documents , with the result that the dilemma of court enforcement occurs .From the perspective of jurisprudence , Li-cense Restrictions is in the danger of improper legislation , examining judicial documents beyond its power and additionally estab-lishing administrative license .Meanwhile , as its regulatory costs are too high and it has to escape false litigation , it makes a mis-take of throwing away the apple because of the core .Thus, it is necessary to break out from the dilemma of court enforcement by integrating the following five paths:improving the record review system of NPC , defining the dominant position of court , smoot-hing relief channel of litigation , starting up procedure for judicial review of administrative litigation , establishing interest expres-sion and communication mechanism of administrative legislation .
