Wartime probation implies a main idea of the criminal procedure law and requires a procedure running mechanism including an application of the wartime probation, declaration of the military court and relevant organic delivery performance. There are many disputes to the executive and investigative organs of the wartime probation in theory circle. It is relatively reasonable and lawful to investigate by military security department and coordinated by other departments and organizations. In alterative executive procedure of the wartime probation there are an investi-gation report procedure of the “offset guilt by merit”, affirmation procedure and the cancellation procedure of the military court.
