新修《消费者权益保护法》的立法精神中，“生活消费”具有市场终端性和市场议价性的特点，患者可属于消费者，医疗机构可属于经营者，医患关系可属于消费关系，因此，医患关系可受新修《消费者权益保护法》调整。《消费者权益保护法》与《医疗事故处理条例》、《侵权责任法》等不是互相排斥的关系，不能以医患关系的特殊性而否定其可适用《消费者权益保护法》。
新脩《消費者權益保護法》的立法精神中，“生活消費”具有市場終耑性和市場議價性的特點，患者可屬于消費者，醫療機構可屬于經營者，醫患關繫可屬于消費關繫，因此，醫患關繫可受新脩《消費者權益保護法》調整。《消費者權益保護法》與《醫療事故處理條例》、《侵權責任法》等不是互相排斥的關繫，不能以醫患關繫的特殊性而否定其可適用《消費者權益保護法》。
신수《소비자권익보호법》적입법정신중，“생활소비”구유시장종단성화시장의개성적특점，환자가속우소비자，의료궤구가속우경영자，의환관계가속우소비관계，인차，의환관계가수신수《소비자권익보호법》조정。《소비자권익보호법》여《의료사고처리조례》、《침권책임법》등불시호상배척적관계，불능이의환관계적특수성이부정기가괄용《소비자권익보호법》。
According to the legislative spirits of the presently renewed Consumer Protection Law,pa-tients can be included in consumers,medical institutions can be included in proprietors,and the doctor-pa-tient relationship can also be included in consumer-proprietors relationship.Consumer Protection Law can be in harmony with Regulations on the Medical Accident Treatment and Tort Liability Law.We can not directly deny doctor-patient relationship ‘s application to Consumer Protection Law,only because of the particularity of doctor-patient relationship.Providing perfecting the system of medical liability insurance, punitive compensation can be somehow attached to medical institutions.
