空间隐私权是隐私权多个权利维度中,性质最原始、内容最广泛的一个,但由于我国隐私权保护处于起步阶段,对空间隐私权的保护几近空白,因此,隐私权保护水平较高的欧美地区的司法判例及其隐私权理论,是拓展我国空间隐私权研究深度和广度的重要经验来源。欧美空间隐私权发展进路主要表现在三个层面:对住宅的保护从财产权发展到人格权;空间隐私领域从私人住宅扩展到公共场所;侵权认定标准从物理性侵入转为合理隐私期待。欧美空间隐私权发展进路背后的隐私权保护理念对我国空间隐私权制度的定位和保护,以及知识经济背景下,我国隐私权制度的构建和完善有着重要的借鉴意义。

Right of privacy of space is the most original and the most extensive dimension in multiple dimensions of right of privacy. Because of privacy protection in our country is at the start stage, the protection of right of privacy of space is nearly blank, therefore, the judicial precedent and theory of privacy in Europe and the United States, is an important experience on the development of right of privacy of China. Europe and the United States space privacy development approach is mainly manifested in three aspects: the residential protection from property rights to the personality right; privacy space is extended from private homes to public places; the standard of infringement from physical intrusion into a reasonable expectation of privacy.Privacy idea behind development approach of Europe and the United States, which is significant to orientation and protection of privacy right in China, as well as building and perfection a privacy system of our country under the background of knowledge economy.
