基本养老保险是我国社会保险的五大险种之一，在保障老年人基本生活方面具有重要作用。而转型期大量“断保”现象的出现不仅给养老保险的运行带来冲击，加剧了个人账户的“空账”压力，也昭示出目前养老保险存在的法治困境与制度缺陷。我国养老保险制度法治化亟待进一步合理调整主体间的责任配置，完善养老保险的运行模式，健全制度内部及其与外部制度的衔接规定，提高养老保险基金的运营与管理效率，从而更好地发挥其应对风险的功能，促进社会与经济稳定且可持续发展。

The basic pension insurance is one of the five main types of social insurance in Chi-na,playing an important role in guaranteeing the basic livelihood of the elderly.Nevertheless, the phenomenon of massive “insurance interruption”in China's social transition period not only brought impact on the running of pension insurance,aggravated the pressure of “empty account”for individuals,but also exposed the predicament of rule of law and legislative defects of the cur-rent pension insurance.The Legalization of China's pension insurance system needs further ra-tionalizing the responsibility configuration between subj ects,reforming pension insurance's opera-tion mode,perfecting the connection regulations between internal and external systems,and im-proving the efficiency of the operation and management of the pension fund,in order to for the fund to play its role of reducing risks better,promoting stable and sustainable development of China's society and economy.
