近些年来，持续发生数起涉及跨国公司在华实施跨国商业贿赂案件。从2004年的“朗讯”风波到近日葛兰素史克(中国)投资有限公司被调查，跨国公司在华的跨国商业贿赂存在手段多样、行为隐蔽、难以追究的特点。除了直接的金钱交易和吃喝玩乐等传统贿赂手段外，更多的跨国公司选择了免费出国旅游、海外培训、赞助领导干部子女到国外留学，合办面向政府官员和企业高管的EMBA班等新的手段。本文在分析跨国公司商业贿赂的危害及原因之后，提出了治理跨国公司商业贿赂的法律建议。
