建筑许可制度是《中华人民共和国建筑法》中明确规定的一项基本制度。建筑许可包括建筑工程施工许可和从业资格两个方面。本文主要介绍施工许可制度，从它的概念入手，着重分析申请领取施工许可证应该具备的条件，不领取施工许可证擅自开工需要承担的法律后果，为建设单位有效落实施工许可证制度奠定基础。
