教学企业是高职教育教学改革与创新的关节点与难点。当前,教学企业的设立存在现实的困境,根据对我国教学企业的涵义与特征的分析,在现有的法律制度条件下,结合教学企业的主要目的与要求,兼有资合和人合双重属性的有限责任公司企业形式是比较适合于教学企业的法律主体形式。但从理论和立法建议上讲,学界提出的社会企业类型或形式可以作为另立的更适合于教学企业建设与发展的企业种类。

Teaching enterprise is a critical point and difficult problem during the reform and innovation of higher vocational education. Currently, there is a real dilemma concerning the establishment of teaching enterprises. According to the analysis of the meaning and characteristics of a teaching enterprise and its main purpose and requirements, we believe that limited liability company is a comparatively suitable legal body form for a teaching enterprise due to its dual attributes of personal cooperation and capital cooperation under the existing legal system conditions in China. However, in terms of theory and legislative proposals, a social enterprise which is proposed by academia can be used as a separate type or form for a teaching enterprise, because it is more suitable for the construction and development of a teaching enterprise.
