法律思维是指法律人在学习、研究、适用法律过程中形成的法律信仰为灵魂、以证说理能力为核心要素、以规范化法律语言为媒介、旨在面向职业和司法实践的观点、立场和价值的总和。当前我国法学教育存在不适应法律思维培养的诸多问题,需要从法学本科教育目的、实践教学体系设计、教学方法改革等方面入手加以完善。

Legal thinking refers to the legal faith formed in the law study, research, and application with the focus on the core elements of evidence-based reasoning and standardization of legal discourse as a medium designed for a professional and judicial practice perspectives, positions and values sum. This paper aims to reveal the problems with China’s current law education out of tune with legal thinking cultivation, which needs to be improved in terms of undergraduate law educational goals-setting, internship design and teaching methods renovation.
