中国社会正处于传统社会向现代社会、农业社会向工业社会、乡土社会向信息社会、熟人社会向陌生人社会转型的时期，社会转型决定了当代中国的法治结构是二元的，即乡土社会的法和现代社会的法并存与对立。现阶段的法治建设的理念和路径选择都要立足于转型社会或社会主义初级阶段这个最大的国情，既不能墨守成规、裹足不前，也不能好高骛远、一蹴而就，而是要在坚持法治基本理念、价值、规律---法治之道的基础上，探索法治实现的独特策略、方法、技术---法治之术。
中國社會正處于傳統社會嚮現代社會、農業社會嚮工業社會、鄉土社會嚮信息社會、熟人社會嚮陌生人社會轉型的時期，社會轉型決定瞭噹代中國的法治結構是二元的，即鄉土社會的法和現代社會的法併存與對立。現階段的法治建設的理唸和路徑選擇都要立足于轉型社會或社會主義初級階段這箇最大的國情，既不能墨守成規、裹足不前，也不能好高騖遠、一蹴而就，而是要在堅持法治基本理唸、價值、規律---法治之道的基礎上，探索法治實現的獨特策略、方法、技術---法治之術。

The essay combines histories and realities of the rule of law into one,giving prominence to relationships between histories and realities.Structure of authority and order and realities of rule of the law require that historical and cultural traditions,the current economic and political system,the logic of the legal system must be taken into consideration.Starting from the transitional society which is the unavoidable the background of the rule of law first,we respect realities of the transitional China,and analysis the isomorphism of state law,and folk Law and confront regional differences in the rule of law the and gain the wisdom of compromise between law and politics in order to actively attempt to get“relative rationalism”methods of rule of law in China with the open inter-regional,international perspective on the basis of analysis of the ways of the rule of law in the transitional society.Views in the essay are basically in conformity with research directions of American Legal Realism and Roscoe Pound’s theory of sociological j urisprudence.
